Booking Terms and Conditions

Once read, please tick box on booking form.

A ticked box on the booking form where it says 'I have read and agree to the terms and conditions' confirms the acceptance of the terms and conditions set out below and shall be binding on the persons booking and intending to occupy the premises. Each booking will be confirmed as soon as the booking from has a ticked box for terms and condition and the appropriate deposit.

No parties of guests who are all under the age of 21 will be accepted. No pets accepted. For the comfort of guests our home is non-smoking, however smoking is permitted on the patio area. Please use ashtrays provided.

To ensure comfort, security and peace of mind our home is registered with the State Authorities and is in full compliance with all relevant legislation.


General:

The villa is available for occupation from 4.00 pm, local time.

Departure time - 10.00 am unless otherwise agreed with the management company.

Smoke alarms are situated around the entire villa. Any tampering with these alarms will result in a deduction of $100 from your security bond.

All local telephone calls are free. All other outgoing calls require a pre-paid phone card, available from any supermarket.

All bed linen and towels are provided for your needs. Please bring your own beach towels for use at the water parks.

Our villa is situated in a quiet residential area. It is a condition of the rental that you should be considerate in your behaviour and keep noise levels to a reasonable level so as not to disturb our neighbours.


Payment Details:

The person, who fills in the Booking Form, certifies that he or she is authorised to accept the Booking Terms and Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The name must be a member of the party occupying the property and must be 21 years or over. Bookings cannot be accepted from parties of young people under 21 years of age.

A non-refundable deposit of $180 USD per week or part week is due within 7 days of your initial reservation, to be sent with the completed Booking Form, which must have a ticked box agreeing with terms and conditions. On receipt of your deposit we will send out a receipt and confirmation of your booking.

The balance must be paid 8 weeks prior to the commencement of the holiday along with a Security Deposit of $320. On receipt, and after clearance of your final payment, we will send out your arrival details and directions.

If the booking is made within 8 weeks of the commencement of holiday, then full payment is required to secure booking.

The Security Deposit will be returned to the Guest within 30 days after the completion of the holiday as long as key(s) are returned and the Owner's Management Company (who will check the inventory prior to your arrival and after your departure), reports no damage, breakages or loss.

Payments for your deposit, balance and security deposit may be carried out via a credit card using Paypal.

We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date.


Price Guarantee:

The price for renting the premises as stated on the booking form at the time of booking is fully guaranteed and no surcharges will be added to the costs shown on the booking form.


Security/Breakages Bond

We require a refundable security/breakage deposit to be paid at the time of your final payment. This deposit of $320 will be repaid to you by cheque or via Paypal back into your credit card (depending on how you paid), within 30 days of your departure, providing the local management have reported no damage or breakages and the door key is in it's lock box. Our management company check the inventory prior to your arrival and after your departure and will advise of any faults. These may include additional cleaning costs for spills, stains etc. Notwithstanding the amount of the security deposit, you are liable for all damage caused to the villa. Thus we reserve the right to pursue you for further monies to cover malicious or avoidable damage over and above the amount of the security deposit.

The back up key for the villa front door must be left in its security box at all times. The loss of the door key will result in a charge of £100.00 / $175.00 from your security bond. This key is only for emergency use if the digital door lock does not operate for any reason.

The client is held responsible for any damage or breakages that may be caused to the property its contents and also for any items in the inventory during your stay. All damage and faults caused or found at the home must be reported to our management company at the earliest opportunity. We know accidents can happen and small breakages for example the odd glass or plate will not be charged to your deposit, but please let us know as soon as possible so that it can be replaced.

The Guest agrees:

To pay the full cost of any breakages, losses or damage to the property (the Owner's Management Company will be sole arbitrators on cause of damage or loss).

To take good care of the property and leave it in a clean and tidy condition at the end of the holiday.

To permit the Owner or their Agents reasonable access to the property to carry out any maintenance if necessary.

Not to sublet or share the property except with persons nominated on the Booking Form.

We retain the right to retain the security deposit (either in part or full) to cover breakages, damage or non-return of keys. Receipts for repairs / replacements will be provided in the unlikely event that such retention of the security deposit is required.

We reserve the right to pursue a quest for recompense for any and all damages caused which may exceed the value of the security deposit within 14 days of being served notice of this.

Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The home is treated regularly as part of a pest and termite control program. We advise you to keep all windows and external doors closed whenever possible; not only will this help to keep bugs from the property, but it will also enable the air conditioning unit to function more efficiently. Apart from spoiling, food left uncovered can attract insects very quickly. Any added costs for pest control services incurred from lack of care in this may be passed to you.

The water in the swimming pool is chlorinated for your benefit but will stain and bleach fabrics. Before entering the Villa from the pool area, please ensure that all guests and particularly children have dried off as much as possible. Wet clothes and towels must not be placed on floors or furnishings.


Safety and Security

Due to State Fire Regulations under no circumstances may more than the maximum number of persons identified on the Booking Form occupy the property.

Children must be supervised at ALL TIMES whilst in the pool area. Glass is NOT permitted in the pool area. Plastic glasses are provided.

The owners, or our management company reserve the right to enter the premises at any time for whatever reason, but we will try to give notice whenever possible.


Pets

Animals/pets are strictly not permitted. If a pet has been in the property, there will be an automatic security deposit charge, to cover the cost of professionally cleaning all carpets and upholstery and to call in a pest control company. This may amount to several hundred dollars.


Pool and Spa Heater

If you have requested pool and/or spa heat, the temperature is subject to prevailing weather conditions, etc. The pool covers must be used to retain the heat when the pool is not in use, especially overnight, and this is the responsibility of the guest at the time.

In the event of pool heater breakdown, or other circumstances beyond our control, we (or our representative) will do our/his utmost to rectify the problem as soon as possible. In such an event our liability will be limited to refunding the pool heat payment to the guest for the number of days the heater was out of action only - no other compensation will be paid.


Security

All doors and windows must be closed and the security alarm at the property must be set whenever you are are not in the property. Guests are responsible for closing all doors and windows, placing patio door bars on and for setting the security alarm. The use of the security alarm is recommended.


Documentation

All passports, visas and health certificate documentation requirements are the clients' responsibility. The owners and their agents accept no responsibility for any delay or expense incurred through any irregularity in such documents.


Liability

The owners and their agents do not accept liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of use of the pool and villa, including items used in the games room. It is your responsibility to ensure that children are always supervised properly in and around the pool and inside the villa or games room. Children are not allowed to move any heavy equipment in the games room.

No liability is accepted by the Owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner.

The Guest is responsible for taking out an adequate insurance policy (ies) to cover all risks. This waiver is also applicable to people visiting the property as guests of the Guest (s).

The Owner does not accept any liability for injury, damage or loss caused, or for any such claim by a third party as a consequence of actions by the Guest(s) and other people occupying the property during the period of the let.

As owners of the property, we, our servants or agents, will not be liable for any loss or delay occasioned by any of the following: strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather transport problems, aircraft, closure of airports, or any other event beyond the owner's control.


Force Majeure

The owners or their agents cannot accept responsibility, be responsible or be liable in respect of damage or changes caused by Force Majeure, e.g. strikes, floods, closure of airports, weather conditions or other events beyond our control.


Complaints or Dissatisfaction

In the unlikely event of a complaint during your stay please contact the Management Company immediately. If the matter cannot be resolved you should contact the owner, in writing, within 14 days of the end of the rental period. If the problem has not been reported, as requested to the Management Company the owner cannot accept any responsibility.


Unavoidable Changes

The owners and their agents reserve the right in any circumstances to cancel the booking and in this event we will return all sums (but without interest or compensation). In the event of a major change to the booking being necessary, we will inform the client as soon as reasonably possible, and if the client does not wish to accept the booking on this basis we will cancel the booking and return all sums (but without interest or compensation).


Cancellation

In the event of your needing to cancel the following fees will apply:

8 or more weeks prior to departure 100% of the deposit paid, less than 8 weeks 100% of total charge.

Please ensure you have adequate Travel Insurance to cover your losses if cancellation is due to an insured event beyond your control resulting in a financial loss.

We want our home to remain as clean and tidy for each and every visitor, so please respect our home and treat it with the care it deserves.
